Dave Mustaine Sues Former Bassist Over Ad

Who Can Use The Name, Megadeth

Megadeth founder and lead singer, Dave Mustaine sued the band's former bass player today for allegedly using the name of the group without permission in an advertisement for musical equipment.

In his complaint filed in Los Angeles Superior Court, Mustaine claims he and Dave Ellefson entered into a settlement agreement in February that restricts the bassist's use of the band name.

"Ellefson shall be permitted to identify himself as the former bassist of Megadeth in his personal biography or resume, and in interviews," the lawsuit quotes the agreement. "Ellefson shall not use the word or mark `Megadeth' in any other way, or for any other purpose."

"Ellefson shall not use, or authorize anyone else to use, the work or mark `Megadeth' to advertise, market or promote any person, band, company, organization, product or services without Megadeth's prior express written permission," it further quotes.

According to the suit, an ad in this month's issue of "Bass Player" features Ellefson holding a Peterson Electro-Musical Product's pedal tuner for bass guitars. Text next to his face includes the names of several bands he is currently involved with (F5, Soulfly and Megadeth.)

Mustaine, who alleges Ellefson failed to get permission to use the name in the ad, is asking for unspecified compensatory, punitive and exemplary damages.

Megadeth was founded in 1983. Ellefson appeared on every album and tour from 1985's ``Killing Is My Business'' to 2002's ``Rude Awakening'' until he got into a disagreement with Mustaine and refused to rejoin the band last year.

metaldominatrix: Yeah.. can you believe there are dumb-asses who would rather see a Stephen Pearcy show than a real metal show like Nevermore, Dream Theater & The Mighty Megadeth? Now *THAT'S* what's really funny... trade in your balls for a set of earings fruitcake.

metaldominator - 8/4/2005 4:00:16 PM

Leather_Lung - 8/4/2005 10:25:40 AM
...THIS JUST IN: Not to be outplayed by his former bandmates, at the next "Dave Mustaine Band" tour, in a courageous act of bravery, Dave's going to have the remaining members of the Mammas and the Poppas headline for him.

Ammo_Dog - 8/4/2005 9:20:59 AM
I saw the "Killing is my Business....and Busines is good" tour back in the day at the immortal FENDERS ballroom in Long Beach. I have always been a HUGE fan, but if has come down to Dave trying to milk the cash cow for it's last drop, then count this Dog out. It is really cool that he has controlled ticket prices for the shows, but the motive behind that is if you save on the tickets, you will spend more cheddar at the shirt stands where they make the most jing. Mo' Money, Mo' Money, Mo' Money!!!!

BrokenClone - 8/4/2005 1:33:37 AM
MegaDave is a busy man... if he's not whining to Lars Ulrich on the Metallica movie Some Kinda Monster or retiring, then getting Chris Poland back to do another album he's now suing his former band mates... he needs some Dr Phil...

dancypants - 8/3/2005 8:48:58 PM
canadians are the true enemy, they can sneak in and out, completely unnoticed unless they say the word "aboot". it's kind of frightening.

VicRattlehead502 - 8/3/2005 5:37:45 PM
..and I'm crushed that I came so close to gaining your admiration, only to throw it all away. You're breaking my heart.

VicRattlehead502 - 8/3/2005 5:36:26 PM
74Scorpio: As imaginative as "fuck face??" I've seen 2 of your rants not including the self-contradicting rant you just made. Each time you open your yap, you contradict yourself. The rant I'm referring to is the o where you bashed AMERICANS for being hostile to the Canadians. Then, RIGHT after you posted that rant, you followed it up with a rant about how stupid americans are and made some crack about our educational system. You're not gonna put out a fire by throwing a can of lighter fluid in it, hoser. But it's nice to know there's fresh meat... metaldominatrix is getting tired and weak, and it's just not a challenge anymore.

74Scorpio - 8/3/2005 3:26:07 PM
I also noticed that most of your insults to metaldominator include 'douche', 'gay' or 'ass'. That shit is PURE genius.

74Scorpio - 8/3/2005 3:15:46 PM
HAHA! Yeah that's a real good one fuck face. Takes a lot of creativity to copy 3 different Megadeth things for a screen name you fuckin' hipocrite. I almost admired you for sticking up for Mustaine so much, but now I can clearly see your a total fucking idiot.

VicRattlehead502 - 8/3/2005 2:38:30 PM
If getting schooled for the 12,567th time means you win... then yes... you're a winner. Congrats. You must be proud.

VicRattlehead502 - 8/3/2005 12:50:19 PM
74Scorpio: No, If I was a goof, I'd have a zodiac sign in my screen name. Were you and metaldominatrix born out of the same ass?

ken_masters - 8/3/2005 11:24:01 AM
FUCK IT!! dave should just start DRINKING again!!
